Terms and Conditions for Halloween Costume Photo Competition

1. Halloween Costume Photo Competition (the “Competition”) is organised by West Kowloon Cultural District Authority (the “Authority”). The Competition is open to Hong Kong citizens aged 18 or above only (each an “Eligible Person”).

2. The Eligible Person may take part in the Competition by (1) posting on the Eligible Person's public Instagram account photo(s) that meet the requirements specified in Clause 3 below during the period from 28 October 2023 00:00 midnight to 31 October 2023 11:59pm (the “Photo(s)”) and maintaining the post of the Photo(s) at least until 14 November 2023; and (2) including in each post of the Photo(s) (a) the hashtag #WestKowloonHalloween, (b) the tag @westkowloonartpark and (c) the tags with at least 3 other Instagram users when the post was first uploaded at least until 14 November 2023. For the purpose of determining the posting time of the Photo(s), the upload or last edit time, whichever is the later, as displayed on Instagram shall be taken. (The Eligible Person who takes part in the Competition pursuant to this Clause is referred to as the “Participant” below.)

3. The Photo(s) shall be taken in any part of the Art Park of the West Kowloon Cultural District (“West Kowloon”) and include the image(s) of the Participant and/or his/her family member(s) and/or friends and/or pet(s), at least one of whom shall be in Halloween costume and/or with feature(s) in connection with Halloween. The Photo(s) must not contain any content that, in the Authority’s opinion which shall be conclusive and final, is or appears to be obscene, defamatory, racist, discriminatory or in any other way unlawful or immoral.

4. By participating in the Competition, the Participant confirms that (1) the Participant shall abide by these terms and conditions, (2) the Participant owns all intellectual property rights (including but not limited to copyright) in respect of the Photo(s) and the Participant thereby grants the Authority a perpetual, unrestricted, royalty-free, irrevocable and worldwide licence to use, adapt and/or publish the Photo(s) for the purposes of and/or in relation to the Competition; and (3) the Participant has obtained consent and authorisation from each and every person whose image appears in the Photo(s) that the Photo(s) may be used, adapted and/or published for the purposes of and/or in relation to the Competition.

5. The Participant shall indemnify, and keep the Authority indemnified, against all claims, costs, charges, expenses, losses and liabilities which the Authority may incur, directly or indirectly, arising from or contributed by the Participant’s breach of these terms and conditions or the use, adaption or publishing of the Photo(s), including but not limited to claims made against the Authority for infringement of a third party’s intellectual property rights.

6. The assessment panel of the Authority (the “Panel”) will select 13 winners (each a “Winner”) from the Participants (or such larger or smaller number of Winners as otherwise decided by the Panel at its sole discretion) whose Photo(s) can, pursuant to the Panel’s assessment result which shall be conclusive and final, best elaborate on the themes of the Competition. The Panel’s assessment of the Photo(s) will be based on the following criteria:

   • Originality;

   • Aesthetics;

   • Composition; and

   • Costume.

7. Subject to Clauses 8 to 10 below, each Winner will be awarded with a prize of dining credits amounting to HK$500 in total (the “Prize”) which may only be used in the designated restaurants and food trucks at West Kowloon within a period of time prescribed by the Authority.

8. Where a Participant is selected as Winner(s) by the Panel in respect of more than one post of the Photo(s), either made by a single Instagram account or different Instagram accounts of the Participant, the Participant will be awarded with the Prize once only.

9. The Winner will be notified of the Prize collection arrangement individually via Instagram Direct Message in or about mid-November 2023 or such other time as announced by the Authority. The Winner should keep the notification message(s) as proof of his or her entitlement to the Prize.

10. The Winner must collect the Prize pursuant to the instructions set out in the notification message(s) within the time specified in such message(s). Any Prize not collected within the specified time shall be forfeited absolutely. The Winner shall have no claim against the Authority for any compensation whatsoever in respect of the forfeiture of the Prize.

11. The Prize is non-transferable, non-refundable and non-exchangeable for cash or other reward.

12. Personal Information Collection Statement (“PICS”): This PICS should be read together with the terms and conditions stated herein. All personal data provided by the Participants will be used for the purposes of the conduct of the Competition, assessment in the Competition and, if applicable, communication on the selection of Winners. Such personal data will be handled in accordance with the Authority’s Privacy Policy (https://www.westkowloon.hk/en/privacy). The Winners will be further required to provide personal data (including but not limited to their full names, Instagram Account Names, mobile phone numbers and email addresses) for the purposes of verification of the identity of the Winners and communication about the Prize collection and/or any other purposes in connection with the Competition. The Winners’ Photo(s), names and/or Instagram Account Names may also be announced and/or published in the Authority’s websites and/or through the Authority’s Instagram Account and/or any other media as may be chosen by the Authority for the purposes of announcement of the Winners’ list and promotion of West Kowloon and/or the Authority. Any personal data relating to the Participants/Winners will not be disclosed to a third party without the prior consent of Participants/Winners, save for the said purposes. If insufficient or inaccurate data is provided by the Participants/Winners , their Photo(s) may not be considered in the Competition or selected as the winning entries of the Competition, their entitlement to the Prize may be forfeited and/or no Prize may be awarded to them. The Participants/Winners have the right to request access to and correct their personal data held by the Authority. Such request should be made in writing to the Data Protection Officer via email at ([email protected]) or by post/in person to the address: West Kowloon Cultural District Authority, 9/F., WKCDA Tower, West Kowloon Cultural District, No. 8 Austin Road West, Kowloon, Hong Kong.

13. Once the photo(s) is/are shared across the Authority’s Instagram Account, the photo(s) and accompanying caption will be subject to the terms outlined in Instagram’s privacy policies (See Link).

14. Instagram contains content and information of other parties, and links to other sites, content and information provided by other parties. The Authority expressly states that it has not approved nor endorsed any such other content, information or links. The Authority shall have no responsibilities for any loss or damage whatsoever arising from any cause whatsoever in connection with the other content, information and links.

15. The Authority shall not be liable for any loss resulting from and/or in relation to incorrect information input, submission delay or loss, and any data transmission error due to technical problems including but not limited to any computer or internet network issues whatsoever.

16. The Authority shall have the right to amend these terms and conditions without prior notice, and/or to cancel the Competition and/or forfeit the entitlement to the Prize of any Winner without giving any reason. The Authority reserves the right of final decision in case of any dispute in relation to these terms and conditions and/or the Competition.

17. If there are any discrepancies between the English version and the Chinese version of these terms and conditions, the English version shall prevail.

Note to Participants (“Trick-or-Treat” and “Meet The Witches”)

1. Participants shall observe and comply with the relevant bylaw and guidelines. For details, please refer to https://www.westkowloon.hk/en/park-bylaw.

2. Children under the age of 12 should always have an adult with them while participating Trick-or-Treat.

3. Please ensure all pets are kept leashed and under control at all times.

4. “Trick-or-Treat” candies and “Meet The Witches” Halloween gifts are available on a first-come, first-served basis and while stocks last.

5. The Authority reserves the right in its sole discretion, to terminate, modify or suspend the activities, for any reason, at any time and without any liability.

If a black rainstorm warning or a typhoon signal no. 8 or above is in force three hours before the start of the event, the event will be cancelled.
